AAA: Bill to Increase Speed Limit to 70 MPH Jeopardizes Lives of Roadway Users AURORA, Ill.--(BUSINESS WIRE)--AAA opposes Senate Bill 3668, which would increase the speed limit on Illinois highways outside the Chicago metro area to 70 mph for both cars and trucks. This bill comes less than three months after a new law took effect, which allows large tractor-trailer trucks to travel at 65 mph on these roads as opposed to 55 mph. We urge state legislators to vote against this bill. “This law also provides no ability to measure the effects of the just-imposed speed limit increase, which is reckless governing when we’re talking about a potential impact in terms of fatalities and injuries.” “We’re deeply concerned for the safety of Illinois’ roadway users with cars and trucks traveling at increasingly high speeds on our interstates,” said Brad Roeber, president of AAA Chicago. “This law also provides no ability to measure the effects of the just-imposed speed limit increase, which is reckless governing when we’re talking about a potential impact in terms of fatalities and injuries.” AAA maintains that Illinois roads are not designed to travel at 70 mph speeds. According to the Illinois Department of Transportation’s Bureau of Design and Environment Manual, Illinois interstates are currently designed for speeds ranging from 60-70 mph. The American Association of State Highway and Transportation Officials defines design speed as “the maximum speed that can be maintained when conditions are so favorable that the design features govern.” Furthermore, speed limits are set lower because conditions are not always favorable and design features do not always warrant higher speeds, according to the Insurance Institute for Highway Safety. Thus, while Illinois roads are designed to a maximum of 70 mph, it’s under the intention that the speed limit is set lower. This bill is especially dangerous and irresponsible given the year-over-year cutbacks to the Illinois State Police budget, which puts fewer troopers on the road. Last year the Illinois State Police budget was cut $24 million and they are facing another $32 million in cuts under Governor Quinn’s proposed budget. “As fewer Illinois State troopers are able to patrol the roadways due to budget cutbacks, it seems inauspicious timing to increase the speed limits on the roadways,” said Roeber. Traveling faster puts roadway users at risk. A 2009 study done by the American Journal of Public Health examined the long term effects of the 1995 repeal of the national speed limit. It found a 3 percent increase in road fatalities attributable to higher speed limits on all road types, with the highest increase of 9 percent on rural interstates. That translates to 90 more people killed in Illinois annually. AAA Chicago has represented roadway interests for motorists and pedestrians and serves as a leading advocate for various traffic safety and travel-related issues for more than a century. For more information on any aspect of AAA Chicago’s breadth of service including AAA’s home, auto and life insurance products; travel-related services, AAA’s Show Your Card & Save program; and/or any AAA membership service including emergency roadside assistance, please visit our Web site at www.AAA.com or call us toll-free at 1-866-YOUR-AAA (968-7222). Toyota disputes recent claims of critics The automaker recently shot back at critics who have blamed defective electronics for vehcile safety issues. Washington (WiredPRNews.com) – Toyota has responded to critics who’ve asserted that electronic errors were to blame for recalled vehicle safety issues. As reported by the Associated Press (AP), experts assembled by the automaker stated Monday that less complex mechical issues were the main contributing factors. Toyota has reportedly recalled 8 million vehicles due to faulty accelator pedals. As noted in the report, the rebuttal comes after the automaker was accused of not fixing the safety problems on recalled cars and trucks, after experiments were conducted by Illinois professor David W. Gilbert showing possible problems within Toyota vehicle systems. Kristen Tabar, an electronics general manager with Toyota’s technical center, is quoted by the AP as stating in reference to the critics’ claims during a news conference, “There isn’t a ghost issue out there.” Accelerator override requirement considered Officials are reportedly considering new requirements for vehicles for the prevention of sudden acceleration issues. Washington (WiredPRNews.com) – The U.S. may begin requiring vehicles to be equipped with components for the prevention of sudden acceleration issues. As reported by the Associated Press (AP), the current administration is considering the action amid reports of a recent Toyota recall on millions of vehicles. Transportation Secretary Ray LaHood is quoted by the AP as stating to the Senate Commerce Committee Tuesday regarding the issue, “We’re looking at it… We think it is a good safety device.” LaHood is further quoted as stating, “We are looking at the possibility of recommending the brake override system in all, newly manufactured automobiles… The U.S. government has to do a much better job of keeping the American people safe.” As noted in the report, Toyota announced this week plans to repair over 1.6 million vehicles worldwide. Federal Government Slam Brakes on Texting Truckers Earlier this year, the Department of Transportation issued a ban on texting by drivers of commercial vehicles, including large trucks and buses. March 07, 2010 /24-7PressRelease/ -- Federal Government Slam Brakes on Texting Truckers Earlier this year, the Department of Transportation issued a ban on texting by drivers of commercial vehicles, including large trucks and buses. Said Transportation Secretary Ray LaHood in a statement, "We want the drivers of big rigs and buses and those who share the roads with them to be safe. This is an important safety step and we will be taking more to eliminate the threat of distracted driving." Drivers of large trucks and buses who send or receive text messages on their cellphones while driving commercial vehicles may be subject to civil or criminal penalties of up to $2,750. Last September, LaHood had announced he wanted to pursue this sort of regulatory policy, as well as additional rules of the road to diminish the impact of distracted driving on the nation's motorists. A number of recent studies have shown the dangers of texting while driving: California bans cellphone use by all drivers while driving. This includes texting by truckers, school bus drivers and drivers of personal vehicles. If you or a loved one has been injured in a crash caused by a distracted driver, contact a San Diego personal injury lawyer or car accident attorney who can evaluate your case, help determine liability and pursue compensation. Article provided by The McClellan Law Firm Honda Also Facing Recall Troubles Most public attention regarding automakers recently has focused on the recall problems facing Toyota, but Toyota is certainly not the only automaker facing such troubles. March 07, 2010 /24-7PressRelease/ -- Honda Also Facing Recall Troubles Most public attention regarding automakers recently has focused on the recall problems facing Toyota, but Toyota is certainly not the only automaker facing such troubles. Honda's auto recall woes are burgeoning; earlier this month, its recall encompassing 443,000 vehicles was expanded to include 378,000 additional vehicles. Although this This recall is expected to cost of Honda $2.2 to $3.3 million. In the United States, the latest round of Honda recall notices apply to 2001 and 2002 models of the Accord, Civic, Odyssey, CR-V, Pilot and 2002 Acura TL and CL vehicles. What may prove more troubling for Honda than the total number of cars needing repair is the seriousness of the potential defect with the airbags in the vehicles. On deployment, excessive pressure can shoot metal shards through the airbag fabric, potentially injuring vehicle occupants. The Wall St. Journal reported that one person has died and 11 were injured in car accidents involving defective Honda airbags. The irony of a device intended to increase occupant safety harming occupants who might otherwise escape injury in a collision is not one likely to set well with Honda owners. Honda has distanced itself from responsibility for the defect underlying its airbag recalls, placing the blame on a particular parts manufacturer. Yoichi Hojo, Honda's chief financial officer, told Reuters that the U.S. unit of Japan's Takata Corp. deviated from the design approved by Honda when manufacturing the airbags. Honda is seeking financial compensation from Takata. Because of its perceived foot-dragging in ordering recalls, Toyota is currently the subject of intense Congressional scrutiny. With Honda having issued its first round of recall notices in November 2008, its second round in July and its third in February, it too may find itself the subject of investigation. The cost of any auto recall decreases with time; when more vehicles in the model class are retired from the road, the automaker has fewer cars to recall. As a result, delaying a recall may provide cost-savings for manufacturers. If a manufacturer knows of defects and delays reasonable action to correct them, however, any savings could be offset by punitive damage awards rendered in product liability lawsuits. Unlike compensatory damages that compensate injury victims for harm suffered, punitive damages are awarded to punish wrongdoers and deter future similar misconduct. Article provided by The McClellan Law Firm Lack of Federal Oversight Partially to Blame for Toyota Crisis As Congress held hearings and members angrily wagged fingers at Toyota executives, some critics pointed at the federal government as a key part of the problems enveloping the Japanese auto giant. March 07, 2010 /24-7PressRelease/ -- Lack of Federal Oversight Partially to Blame for Toyota Crisis As Congress held hearings and members angrily wagged fingers at Toyota executives, some critics were pointing at the federal government as a key part of the problems enveloping the Japanese auto giant. Vista, Calif. Rep. Darrell Issa co-chaired a hearing of the House Committee on Oversight and Government Reform addressing the recent recalls, the National Highway Traffic Safety Administration's handling of consumer complaints and oversight of automakers. Oversight lacking As lawmakers probed Toyota's internal efforts to quash U.S. government investigations and its efforts to fix reported problems with sudden acceleration and braking in its cars, they also cast an increasingly skeptical eye toward the NHTSA. When the agency receives consumer complaints about defects in vehicles, it opens an investigation in which its engineers conduct evaluations of the reported flaws. One of the problems Transportation Secretary Ray LaHood has acknowledged is that only two of the agency's 125 engineers are electronics engineers. Complaints about Toyota vehicles have ranged from problems with floor mats, gas pedals that stick and brakes that fail. As a result, there have been widely publicized reports of crashes, injuries and more than 30 deaths nationwide. The automaker has recalled over eight million vehicles so far. New safety laws looming Agitated by consumer outrage over the failure of the highly regarded corporate culture of Toyota and the federal government's own consumer watchdogs, lawmakers are threatening new legislation to prevent future safety scandals of this scope. One proposal would require automakers to install data recorders in every vehicle -- black boxes similar to those in airplanes -- containing accident and performance data downloadable by regulators. Toyota says recent models contain such devices, but admitted there's only a single machine in the entire country capable of reading the boxes, and that a company representative must be present while the machine is operated. Another legislative proposal would require new cars to have brake override systems; software ensuring that an engine's throttle goes to idle whenever the brakes are deployed. Congress will also consider empowering NHTSA with the authority to levy criminal penalties on automakers that delay safety recalls. The agency can currently assess civil penalties of up to $16.4 million, but it hasn't used this power since 2004. Have you been affected by Toyota's failures? If you or a loved one has been hurt in a San Diego car accident because of a defect in a Toyota vehicle or another vehicle brand, contact a personal injury lawyer who can evaluate your case and help you use the law to protect yourself and your family. Article provided by The McClellan Law Firm Examining the Rise in Motorcycle Accidents The Federal Highway Administration will fund a study designed to pinpoint causes of the increasing fatality rate among motorcyclists and identify prospective interventions. March 07, 2010 /24-7PressRelease/ -- Examining the Rise in Motorcycle Accidents A 150 percent jump in motorcyclist fatalities recorded by the U.S. Department of Transportation in the past decade has researchers perplexed. Motorcyclists are considered the highest risk motorist group, accounting for 14 percent of all fatal traffic incidents. DOT's Fatality Analysis Reporting System recorded 5,290 crash deaths among motorcyclists in 2008 and 96,000 injuries. The traffic fatality rate for motorcycle riders has steadily increased since 1997, while other motor vehicle-related deaths declined. The greatest number of motorcyclist deaths on the road, 36.4 percent, involve front-end crashes with other vehicles. Collisions with motor vehicles overall are responsible for slightly less than half of the annual death toll among motorcyclists, according to the federal data. The Federal Highway Administration will fund a study by Oklahoma State University's Oklahoma Transportation Center designed to pinpoint causes of the increasing fatality rate among motorcyclists and identify prospective interventions. Researchers will study commonalities among motorcycle crashes ranging from road configurations and environmental conditions to rider experience in assessing the reasons for the high rate of fatalities among motorcyclists. The Oklahoma Transportation Center research follows a 1981 NHTSA-sponsored study as well as a study conducted by the Association of European Motorcycle Manufacturers from 1999 to 2000 and one conducted in Thailand in 2001. The 1981 study found several factors contributing to motorcycle fatalities, including auto driver failure to detect motorcyclists and lack of safety equipment such as helmets. The study recommended improved licensing and training, as well as measures to make motorcyclists more conspicuous on the roads. The European study again cited driver error, attributing 50 percent of crashes to auto drivers and 37 percent to motorcycle operators. Significantly, more motorcycle crashes occurred on straight roadways and minor roads than on curved roads or major highways. Unlike the American and European studies, the Thailand study found rider error to be the major contributor to motorcyclist fatalities, with alcohol implicated in 40 percent of crashes. The most common type of crash was the motorcyclist rear-ending an auto. In the Thai research, only a single motorcyclist acknowledged receiving any training in operating motorcycles; the study concluded that the absence of training led to the high rider error rate. The upcoming study in Oklahoma will build on the knowledge attained in earlier studies, establishing which crash causes remain of concern and which interventions undertaken in response to earlier studies have proven effective, as well as identifying new contributors to the high incidence of motorcycle crashes. Article provided by The McClellan Law Firm Las Vegas Near Top of DUI List Las Vegas came in 11th on the March 2010 list of drunkest cities in the U.S. , just falling short of the top 10 for deaths, arrests and binges related to alcohol and alcoholism. March 07, 2010 /24-7PressRelease/ -- Las Vegas Near Top of DUI List Despite its reputation, Las Vegas did not make the No. 1 spot on the March 2010 list of drunkest cities in the U.S. It did, however, come in 11th, according to Las Vegas Weekly, just falling short of the top 10 for deaths, arrests and binges related to alcohol and alcoholism. This does not mean that alcohol does not cause problems in Sin City. Few bars and other establishments in Las Vegas ever announce a "last call" because visitors and locals are known to party all night long. For some, this means that there is never a stopping point for alcohol consumption, leading to alcohol poisoning, drunk driving and other serious problems. The prevalence of gambling in Las Vegas may also play a part in the city's high national ranking. Gamblers often drink for free in the casinos, and it is not uncommon for some gambling patrons to lose count of the number of cocktails they have imbibed before calling it quits. The drunkest cities list compiles data from numerous sources and includes statistics related to liver disease and the specifics of DUI penalties, as well. Not all alcoholism is related to partying and gambling, however, and although Las Vegas boasts both in excess, there are certainly other reasons for the severity of this problem. Several other west-coast cities made the list of drunkest in the nation, including Reno, Nevada, which came in at the No. 2 slot. Others include Fresno and Modesto, California, and Tucson, Arizona. According to AlcoholAlert.com, 33 percent of all traffic fatalities in Nevada in 2008 were alcohol-related with a Blood Alcohol Content (BAC) of 0.08 or greater. This statistic, of course, includes all of Nevada rather than just Las Vegas. It is possible that Nevada will impose harsher DUI laws in the future, though other alcohol-related issues, such as binge drinking and public intoxication, must be considered as part of the equation.
